<description><![CDATA[<b>1. Objectives and Context</b>
The objective of this document is to provide high level advice on how to ensure open source software is fairly considered when procuring an ICT solution. Providing a level playing field for open source entails ensuring that the requirements specified are justifiable and output based taking into account operational and technical requirements and cost. Procurers should not be naming a particular software vendor or drafting the tender documentation in a way that favours a particular vendor. To do so is a breach of EU procurement rules. Where projects are being evaluated by ERG questions are being asked about whether open source has been considered.
This document does not endorse open source over proprietary software or vice versa. Current Government Policy states, however, that where there is no significant overall cost difference between open and non-open source products, open source will be selected on the basis of its inherent flexibility.
Because of the wide range of open source provision, this document provides general advice only and highlights issues you may need to consider. It is intended that there will be ongoing work to incorporate information on the SME agenda and to provide template clauses for Invitations to Tender etc. This note also forms part of a larger toolkit.<br /><br />
<b>2. Background to Open Source Software</b>
Open source software is a software development and distribution model where the software license guarantees certain freedoms. These include the right to access and modify the source code and to reuse and re distribute the software without constraint or undue cost. This is in contrast to the traditional proprietary software development and distribution model where access to source code is restricted by the vendor. Usually, reverse engineering, modification, reuse or redistribution of the software is restricted under the proprietary software licence agreement.
Generally speaking, the strength of open source lies in its; no license costs, interoperability, easier integration and customisation, compliance with open technology and data standards and freedom from vendor lock in. Studies have shown that the benefits of open source generally materialise in the medium to long term. Furthermore, because open source software is free, there is greater flexibility in selecting the level of services or support that a customer wants to pay for, if at all.
<b>3. EU Procurement Rules</b>
Where the software is free to use ‘gratis’ software and all associated products are free for the whole of life use then there is no requirement to tender the requirement for the licenses. It is important from a procurement perspective to ensure that the whole life costs are examined, as although the software cost may appear free at the point of access it may not be free through life. <p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Arial"><br />The HMG ICT strategy published in March 2011, restates Government’s aim to create a level playing field for the consideration of open source and proprietary software solutions.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Arial"><br />Government Policy states that ‘Procurement decisions will be made on the basis on the <span style="font: 12.0px Helvetica"><b>best value for money solution to the business requirement, taking account of total lifetime cost of ownership of the solution</b></span>, including exit and transition costs, after ensuring that solutions fulfil minimum and essential capability, security, scalability, transferability, support and manageability requirements’.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Arial"><br />Total Cost of Ownership (TCO) allows departments to look at both the short and long term costs of any particular solution. Although full life costs are often calculated for business cases this is seldom the same thing as TCO. Traditionally cost has been associated with the purchase price alone or purchase price plus support costs, however the initial procurement cost is typically only a relatively small percentage of the total cost of owning and operating most IT products.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Arial">This is often expressed using the example of a puppy. Whilst a rescued puppy itself may be free, the cost of keeping that puppy for its whole lifetime most certainly will not be. The puppy will require many things such as food, shelter, and vaccinations and these things all have a cost. In caring for the animal over its lifetime you will have spent a substantial amount of money, despite it costing you nothing to actually acquire the puppy at the outset.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Arial"><br />TCO models were initially developed by Gartner in 1987 and are now widely used to assist decision making relating to the selection or procurement of an Information Technology product. TCO looks at the complete cost from purchase to disposal and is a way of thinking about cost when attempting to fairly assess the merits of open source vs. proprietary.</p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Arial"><br />It is often difficult to predict accurately what the lifetime costs of a solution will be, particularly in relation to change so carrying out a Total Cost of Ownership (TCO) assessment provides an opportunity to identify, explore and challenge any assumptions and biases. Calculating Total Cost of Ownership (TCO) is necessary to quantify and compare costs of all software options, and applies equally to proprietary and open source. A TCO assessment of open source software suitability should be no more difficult than assessment of closed commercial software<span style="color: #ff0266">.</span></p>
<p style="margin: 0.0px 0.0px 0.0px 0.0px; font: 12.0px Arial"><br />This document provides a list of some cost items which can be calculated in order to reach a figure for Total Cost of Ownership. Work in this area is still ongoing and a future version of this document will give guidance in greater depth. Viele Fragestellungen, die seitdem in diesem Zusammenhang an die Autoren herangetragen wurden, behandeln Themen wie praktische Aspekte und Besonderheiten bei Softwaremigrationen, die Regelung der Haftung im Zusammenhang von quelloffener Software und z.B. Lizenzfragen bei der Verwendung von quelloffener Software – mit dem Hauptaugenmerk auf die öffentliche Verwaltung. Nunmehr hat die Bundesstelle für Informationstechnik (BIT) in Zusammenarbeit mit dem Bundesministerium des Innern und der 4Soft GmbH den Migrationsleitfaden vollständig überarbeitet und neu strukturiert.]]></description>

<description><![CDATA[<b>Open Source ist keine Glaubensfrage<br /></b><br />Auch wenn das Thema Open Source in Fachkreisen oft emotional beladen ist und immer noch Unklarheiten herrschen, gibt es eine klare Definition und objektive Vor- und Nachteile betreffend OpenSource Software. So wird Software dann als Open Source bezeichnet, wenn sie unter einer von der Open Source Initiative anerkannten Open Source Lizenz veröffentlicht wurde. Solche Lizenzen erlauben, die Soft­ware kostenlos zu kopieren und den Quellcode beliebig zu verbessern und zu verbreiten — Freiheiten, die mit proprietärer Software nicht möglich sind. Dieselbe Software kann somit von unterschiedlichen Firmen integriert und gewartet werden, wodurch die Abhängigkeit zum Software-­Hersteller, der so genannte Vendor Lock-­in, sinkt. Gleichzeitig müssen technisches Knowhow erarbeitet und die mit der Open Source Lizenz verbundenen Pflichten genau eingehalten werden.<br /><br />
<p style="display: inline !important; "><span style="font-weight: normal; "><b>Open Source Software muss gesteuert werden</b><br /><br />Obwohl selten Marketing für Open Source Software betrieben wird, findet sich heute in jedem Betriebssystem und in fast jeder Fachapplikation Software unter Open Source Lizenzen. Zudem werden immer noch in vielen Entwicklungsabteilungen Open Source Komponenten und Software-­Lösungen in geschäftskritischen Anwendungen eingesetzt, ohne dass dies den Verantwortlichen bewusst ist. Um den   Umgang mit Open Source Software gezielt zu steuern und die IT Governance zu verbessern, führen Verantwortliche heute oft spezifische Open Source Strategien, Policies oder Architekturrichtlinien ein.<br /><br /><br /><b>Volles Potential mittels Open Source Strategie nutzen<br /><span style="font-weight: normal; "><br />Wird Open Source Software unkontrolliert eingesetzt, kann das volle Potential selten ganz ausgeschöpft werden. Eine ganzheitliche, auf die jeweilige Organisation angepasste Open Source Strategie ist daher notwendig, um unerkannte Chancen zu nutzen, Risiken frühzeitig zu erkennen und entsprechende Massnahmen festzulegen. Sei es beim Einsatz von vollständigen Open Source Lösungen, bei der Verwendung von Open Source Komponenten in der Software-­Entwicklung oder gar bei der Lancierung einer eigenen Open Source Community — ein vorausschauendes Vorgehen ist in jedem Fall von Vorteil. Lizenzrechtliche Aspekte spielen dabei genauso eine zentrale Rolle wie auch Software-­Beschaffung, Gesamtkostenbetrachtung, Evaluation und nachhaltiger Knowhow Aufbau.<br /><br /><br /><b>Wissen aus erster Hand ist gefragt</b><br /><br />In einem derart dynamischen Umfeld wie bei Open Source Communities entwickeln sich je nach Ausgangslage neue Software-­Projekte rasant zu disruptiven Innovationen. Aber auch etablierte Open Source Lösungen können durch starke Veränderungen in deren Communities rasch Neupositionierungen im Markt erlangen. Laufend werden neue Geschäftsmodelle und Lizenzierungssysteme sowie Analyse-­ und Evaluationsmethodiken entwickelt. Wie in dieser Publikation aufgezeigt, existieren verschiedene Good Practices. Deren Anwendbarkeit und Umsetzung muss dennoch stets individuell betrachtet werden. <description><![CDATA[Da im Zuge eines geplanten Betriebssystemwechsels die Textverarbeitung „Lotus WordPro“ nicht mehr fortgeführt werden kann, wurde von der Bundesrechenzentrum GmbH (BRZ) 2007 der Umstieg auf eine neue Standardtextverarbeitung für die Justiz evaluiert. Auch ein selbst entwickelter Texteditor für Justizanwendungen soll nicht weiter ausgebaut werden. Die langfristige Zielsetzung lautet, in der Justiz grundsätzlich nur eine Textverarbeitung einzusetzen, welche in Java-Anwendungen integrierbar ist und die Erstellung von Dokumenten mit Import von Daten aus den Justizanwendungen erlaubt. Außerdem soll (u.a. durch das Open Document Format – ODF) die Abhängigkeit von einem einzelnen Softwarelieferanten vermieden werden.]]></description>
